1. About SmartType
SmartType is a productivity application that helps users create, organize, search, sync, and insert saved text snippets and related content across supported Apple platforms. The Services may include a standalone app, custom keyboard functionality, cloud-backed features, and optional premium functionality.
2. Acceptance of the Terms
By downloading, installing, accessing, or using SmartType, you agree to these Terms of Service. If you do not agree, do not use the Services.
3. Eligibility
You may use the Services only if you are legally able to enter into a binding agreement and you meet the age of digital consent in your jurisdiction, or any higher minimum age disclosed on the applicable App Store product page. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
4. License and App Store Terms
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use SmartType on Apple-branded devices that you own or control, solely as permitted by these Terms and the applicable Apple usage rules.
SmartType is licensed, not sold, to you. Your use of the Services is also subject to applicable third-party terms, including Apple terms for the App Store, Mac App Store, Apple ID, iCloud, and your device or network provider where relevant.
These Terms are between you and Oleksandr Momotiuk, and not with Apple. Apple is not responsible for SmartType, its content, maintenance, or support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
You represent that you are not located in a country or region subject to applicable embargo restrictions and are not listed on any applicable prohibited or restricted party list to the extent such restrictions apply to your use of the Services.
5. Subscriptions, Purchases, and Refunds
SmartType may offer a free tier and may also offer paid subscriptions, free trials, lifetime purchases, and other premium features now or in the future.
All billing, payment processing, subscription management, renewals, cancellations, and refunds for purchases made through the App Store or Mac App Store are handled solely by Apple under Apple's terms, policies, and platform workflows. We do not process payments directly and do not issue refunds directly for App Store purchases.
If you request a refund for an App Store purchase, that request must be submitted to Apple through Apple's refund process. Eligibility for a refund is determined only by Apple and any mandatory consumer rights that apply to you under law.
6. Current and Future Features
SmartType may include current and future functionality, tools, and features made available as part of the Services. This may include functionality related to creating, storing, organizing, syncing, sharing, processing, transforming, importing, exporting, and otherwise using text, templates, prompts, audio, and related content across supported devices and services.
Some features may require internet access, permissions, Apple services, compatible hardware, or paid access. Some features may be changed, limited, suspended, or discontinued at any time.
7. Your Content and Cloud Sharing
You retain ownership of the text, templates, prompts, documents, or other material you create, store, or submit through SmartType ("Your Content").
By using the Services, you grant us a limited, non-exclusive license to host, process, store, reproduce, transmit, format, display, and otherwise use Your Content only as reasonably necessary to operate, secure, improve, and provide the Services.
SmartType is designed primarily for private user content. Your content is not made available to other users unless you choose to share it directly through available sharing features, such as CloudKit sharing. If you share content with another user, you are responsible for what you share and with whom you share it. Shared content may be visible to the recipients you select and may be copied or reshared by them. Any template collections or similar resources we may offer are not intended to make one user's private content publicly available to other users unless that user has explicitly shared it.
You represent that you have all rights necessary to store, use, and share Your Content and that Your Content does not violate law, these Terms, or the rights of others.
8. Prohibited Use
You may not use SmartType to:
- break the law or violate the rights, privacy, or safety of others;
- store, share, or generate abusive, harassing, defamatory, fraudulent, or infringing material;
- phish, steal credentials, spread malware, or facilitate spam or other harmful conduct;
- attempt unauthorized access to the Services, related systems, or other users' data;
- reverse engineer, decompile, disassemble, or attempt to derive source code except where law permits;
- scrape, automate, or abuse the Services in a way that disrupts performance or availability;
- misuse AI or voice-related functionality to create unlawful, deceptive, or harmful content;
- upload or share content that you do not have the right to use or disclose.
We may suspend, restrict, remove, or terminate access where we reasonably believe your use violates these Terms, creates risk, or could harm users, third parties, or the Services.
9. Intellectual Property
SmartType, including its software, design, branding, graphics, interface elements, and all related intellectual property rights, is owned by or licensed to Oleksandr Momotiuk and is protected by applicable law. Except for the limited license granted in these Terms, no rights are transferred to you.
If a third party claims that SmartType infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of that claim to the extent required by applicable law and Apple's platform terms.
10. Privacy and Data Use
Your use of the Services is also governed by the SmartType Privacy Policy: https://luckybeans.app/smarttype/privacy-policy.
Depending on the features you use, SmartType may process content such as snippets, template values, shared data, diagnostics, crash data, and feature usage information. Certain functionality may also depend on Apple services such as iCloud or CloudKit.
11. Availability and Changes
We may update, improve, limit, suspend, or discontinue any part of SmartType at any time. We do not guarantee that any feature, storage option, sync behavior, public template library, collaboration workflow, AI tool, or voice feature will remain available, accurate, or uninterrupted.
You are responsible for maintaining your own backups of important content. While cloud and backup features may be offered, SmartType is not a guaranteed archival service.
12. Disclaimers
SmartType is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We disclaim all warranties, express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, quiet enjoyment, and that the Services will be uninterrupted, error-free, secure, or suitable for your needs.
AI-generated, suggested, or transcribed output may be inaccurate, incomplete, biased, offensive, or unfit for your intended use. You are responsible for reviewing and deciding whether to use any output.
13. Limitation of Liability
To the maximum extent permitted by law, Oleksandr Momotiuk will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, business, opportunity, goodwill, data, or content, arising from or related to SmartType or these Terms.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Services will not exceed the greater of the amount you paid for SmartType in the twelve months before the event giving rise to the claim, or fifty euros (EUR 50).
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including rights that may apply to consumers.
14. Termination
These Terms remain in effect until terminated by you or us. You may stop using SmartType at any time and may remove the app from your devices. We may suspend or terminate your access at any time if we reasonably believe you violated these Terms, created legal or security risk, or misused the Services.
Sections that by their nature should survive termination will survive, including sections on payments, intellectual property, disclaimers, limitation of liability, dispute resolution, and miscellaneous terms.
15. Governing Law and Disputes
These Terms and any non-contractual disputes or claims arising out of or in connection with them are governed by the laws of Poland, without regard to conflict-of-law principles.
You agree that the courts of Poland will have exclusive jurisdiction over disputes arising out of or relating to SmartType or these Terms, except where mandatory consumer law provides otherwise.
16. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. We may assign these Terms in connection with a business transfer, reorganization, or sale of the Services. You may not assign your rights or obligations under these Terms without our prior written consent.
These Terms, together with any applicable additional terms and the Privacy Policy, form the entire agreement between you and us regarding SmartType.
