1. About PunchMate
PunchMate is a productivity tool for documenting projects and site issues, adding and marking up photos, and generating PDF reports. The app is provided by Oleksandr Momotiuk.
2. Acceptance and Eligibility
By downloading, installing, or using PunchMate, you agree to these Terms. If you do not agree, do not use the app. You must be legally able to enter into this agreement. If you use PunchMate for an organization, you confirm that you have authority to act for that organization.
3. Apple Standard EULA
Your license to use PunchMate is governed by Apple's Standard EULA. These Terms add only product-specific rules for PunchMate.
These Terms do not grant a separate app license and do not replace or modify the Standard EULA. If these Terms conflict with the Standard EULA or mandatory law, the Standard EULA or mandatory law controls to the extent of the conflict.
4. Free and Paid Features
PunchMate may provide a free tier with limits and PunchMate Pro through an App Store subscription. Available features, limits, subscription duration, price, and any trial or introductory offer are shown in the app before purchase.
Subscriptions renew automatically unless canceled through your Apple account before renewal. Apple handles billing, renewals, cancellations, and refunds under its terms and applicable law. We do not process payment cards or issue App Store refunds directly.
We may change future plans, feature limits, and prices. Any change to an active App Store subscription is handled through Apple and remains subject to mandatory consumer rights.
5. User Content and Responsibilities
You retain ownership of all information and content entered into or created with PunchMate ("User Content"). PunchMate processes User Content only as necessary to provide app features and iCloud synchronization, as explained in the Privacy Policy.
You are responsible for ensuring that User Content is accurate, lawful, and suitable, that you have the necessary rights and permissions, and that your use of PunchMate complies with applicable legal, workplace, safety, and professional requirements.
6. Reports and Professional Use
PunchMate helps organize information; it does not inspect a site, verify User Content, certify work, or provide engineering, construction, safety, legal, or other professional advice.
You must review every report before relying on or sharing it. You remain responsible for professional judgments, deadlines, notices, regulatory compliance, and actions taken based on information in PunchMate. Information in a report may be incomplete or inaccurate.
7. Storage, iCloud, and Sharing
PunchMate stores User Content on your device and may sync it through your Apple iCloud account when available. Sync, backups, and third-party destinations may be unavailable, delayed, or affected by device, network, or Apple-service conditions.
PunchMate is not a guaranteed archival or backup service. Keep independent copies of records that are important for your business, legal obligations, or safety.
When you choose to export or share User Content, you are responsible for the destination, recipients, access permissions, and any further use or disclosure.
8. Prohibited Use
You may not use PunchMate to:
- violate law or the rights, privacy, or safety of another person;
- store or share material you do not have the right to use or disclose;
- introduce malware, disrupt the app, or attempt unauthorized access to related systems;
- reverse engineer, decompile, or derive source code except where applicable law expressly permits it; or
- use PunchMate in a fraudulent, abusive, deceptive, or dangerous way.
9. Intellectual Property
PunchMate's software, design, branding, interface, and other app materials, excluding User Content, are owned by or licensed to Oleksandr Momotiuk and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of PunchMate to you.
10. Privacy
The PunchMate Privacy Policy explains how PunchMate handles User Content and Technical Data. It applies separately from these Terms.
11. Availability and Disclaimers
We may update, improve, restrict, or discontinue parts of PunchMate, subject to applicable law and any active paid entitlement. Some features require compatible Apple devices, permissions, internet access, iCloud, or App Store services.
To the maximum extent permitted by law, PunchMate is provided "as is" and "as available." We do not guarantee uninterrupted operation, error-free sync, permanent storage, or that reports will meet every legal, contractual, or professional requirement.
12. Limitation of Liability
To the maximum extent permitted by law, Oleksandr Momotiuk will not be liable for indirect, incidental, special, consequential, or punitive loss, or for loss of profit, business, opportunity, data, content, or goodwill arising from PunchMate.
We are not responsible for losses caused by inaccurate or incomplete User Content, professional decisions, failure to keep independent records, third-party services, or content you choose to export or share. Nothing in these Terms limits liability where limitation is prohibited by law.
13. Termination
You may stop using PunchMate and remove it from your devices at any time. Canceling a subscription stops future renewals but does not automatically delete User Content stored on your device or in iCloud.
We may restrict access to service-dependent features if you materially violate these Terms or create a legal or security risk. Provisions concerning content responsibility, intellectual property, disclaimers, liability, and governing law survive termination where their nature requires it.
14. Governing Law
These Terms are governed by the laws of Poland, without regard to conflict-of-law rules. If you are a consumer, mandatory protections and rights to bring a claim in your country of residence remain unaffected.
15. Changes and Contact
We may update these Terms as PunchMate or applicable requirements change. We will update the "Last updated" date and provide additional notice when required. Continued use after updated Terms take effect means the updated Terms apply, except where law requires separate consent.
