1. About Foxlin
Foxlin is a vocabulary learning app that helps users create and practice flashcards, review terms, track learning progress, and optionally generate or translate cards with AI-assisted features.
2. Acceptance of the Terms
By downloading, installing, accessing, or using Foxlin, you agree to these Terms of Use. If you do not agree, do not use Foxlin.
3. Eligibility
You may use Foxlin only if you are legally able to enter into a binding agreement and you meet the age of digital consent in your jurisdiction, or any higher minimum age disclosed on the applicable App Store product page.
4. License and App Store Terms
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Foxlin on Apple-branded devices that you own or control, solely as permitted by these Terms and Apple's applicable usage rules.
Foxlin is licensed, not sold, to you. Your use of Foxlin is also subject to applicable third-party terms, including Apple terms for the App Store, Apple ID, iCloud, and your device or network provider where relevant.
These Terms are between you and Oleksandr Momotiuk, and not with Apple. Apple is not responsible for Foxlin, its content, maintenance, or support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
5. Subscriptions, Purchases, and Refunds
Foxlin may offer a free tier and may also offer paid subscriptions, free trials, lifetime purchases, or other premium features now or in the future.
App Store purchases, billing, renewals, cancellations, and refunds are handled by Apple under Apple's terms, policies, and platform workflows. We do not process payment card details directly and do not issue refunds directly for App Store purchases.
If you request a refund for an App Store purchase, that request must be submitted to Apple through Apple's refund process. Eligibility for a refund is determined by Apple and any mandatory consumer rights that apply to you under law.
6. Features and Permissions
Some Foxlin features require device permissions, Apple services, internet access, compatible hardware, iCloud availability, notifications, or paid access. If you do not grant or later revoke a required permission, some features may not work.
Foxlin may change, limit, suspend, or discontinue features at any time, including AI functionality, sync behavior, premium offerings, and supported languages.
7. Your Content and AI Features
You retain ownership of the decks, flashcards, terms, translations, topics, and other material you create, store, submit, or import through Foxlin ("Your Content").
Foxlin is designed to keep Your Content on your device and, when enabled, in your Apple iCloud account. We do not require you to create a separate Foxlin account for this content.
Optional AI features may send the prompt, text, language choices, or other content you intentionally submit to OpenRouter and relevant model providers to generate a response. You authorize that transmission when you choose to use an AI feature. Do not submit sensitive personal information, confidential information, or information about other people unless you have the right to do so.
AI-generated or translated output may be inaccurate, incomplete, offensive, or unsuitable for your intended use. We are not responsible for AI responses, and you are responsible for reviewing output before relying on it or adding it to your study materials.
We do not promise unlimited access to AI features. AI access may be subject to usage limits, fair-use limits, paid feature limits, provider limits, availability limits, or technical limits. We may reduce, pause, or disable AI features at any time, including to control cost, prevent abuse, maintain reliability, or respond to third-party service changes.
You represent that you have all rights necessary to store, use, submit, translate, generate, and share Your Content and that Your Content does not violate law, these Terms, or the rights of others.
8. Prohibited Use
You may not use Foxlin to:
- break the law or violate the rights, privacy, or safety of others;
- store, submit, generate, translate, or share unlawful, abusive, fraudulent, or infringing material;
- submit sensitive, confidential, or third-party information without proper rights or consent;
- attempt unauthorized access to Foxlin or related systems;
- reverse engineer, decompile, disassemble, or attempt to derive source code except where law permits;
- misuse Foxlin, including AI features, in a way that harms others or disrupts the app.
We may limit access to online, AI, or premium features if we reasonably believe misuse is occurring.
9. Intellectual Property
Foxlin, including its software, design, branding, graphics, interface elements, and related intellectual property rights, is owned by or licensed to Oleksandr Momotiuk and is protected by applicable law. Except for the limited license granted in these Terms, no rights are transferred to you.
If a third party claims that Foxlin infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defense, settlement, and discharge of that claim to the extent required by applicable law and Apple's platform terms.
10. Privacy and Data Use
Your use of Foxlin is also governed by the Foxlin Privacy Policy: https://luckybeans.app/foxlin/privacy-policy.
As described in the Privacy Policy, Foxlin is designed to keep your learning content on your device and, when enabled, in your Apple iCloud account. Foxlin may use limited Firebase Analytics, purchase and entitlement information from Apple and RevenueCat, support communications you send, and AI request content you choose to submit.
11. Availability and Changes
We may update, improve, limit, suspend, or discontinue any part of Foxlin at any time. We do not guarantee that any feature, sync behavior, AI tool, subscription offering, or supported language will remain available, accurate, unlimited, or uninterrupted.
You are responsible for maintaining your own backups of important content. While iCloud sync or backup features may be available, Foxlin is not a guaranteed archival service.
12. Disclaimers
Foxlin is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We disclaim all warranties, express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, quiet enjoyment, and that Foxlin will be uninterrupted, error-free, secure, or suitable for your needs.
Foxlin does not provide medical, mental health, educational, legal, financial, or professional advice. Learning progress, AI output, translations, and recommendations may be incomplete, inaccurate, delayed, or unavailable. You are responsible for deciding whether any AI response or translation is appropriate for your use.
13. Limitation of Liability
To the maximum extent permitted by law, Oleksandr Momotiuk will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, business, opportunity, goodwill, data, content, AI output, translations, or app availability, arising from or related to Foxlin or these Terms.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to Foxlin will not exceed the greater of the amount you paid for Foxlin in the twelve months before the event giving rise to the claim, or fifty euros (EUR 50).
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including rights that may apply to consumers.
14. Termination
These Terms remain in effect until terminated by you or us. You may stop using Foxlin at any time and may remove the app from your devices. We may limit online, AI, or premium functionality if we reasonably believe you violated these Terms, created legal or security risk, or misused Foxlin.
Sections that by their nature should survive termination will survive, including sections on payments, intellectual property, disclaimers, limitation of liability, dispute resolution, and miscellaneous terms.
15. Governing Law and Disputes
These Terms and any non-contractual disputes or claims arising out of or in connection with them are governed by the laws of Poland, without regard to conflict-of-law principles.
You agree that the courts of Poland will have exclusive jurisdiction over disputes arising out of or relating to Foxlin or these Terms, except where mandatory consumer law provides otherwise.
16. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver.
These Terms, together with any applicable additional terms and the Privacy Policy, form the entire agreement between you and us regarding Foxlin.
